Would you wish them to see a ground in which the appellation false suit the epithet false with the expression of censure attached to it may be employed with real advantage, under the auspices of truth and justice[?] to turn to jurisprudence. It is there you may see false suit, false suit in abundance, employed for the worst purposes, and with but two extensive an effect: - to nip the faculty of reason in the mind to deprive the disective faculty of its sharpness and its strength: to instill in the mind of the lawyer the art of deception, and in the mind of the suitor the disposition to be deceived: to teach men to be satisfied with sham reasons, as they would with true ones.

To look upon the man of law as their friend, and him who would rescue them (from his grip), as their enemy.

To suspect be jealous of their friends, and have no confidence but in their enemies.

To look up on remedies as poisons, and poisons as remedies to teach them to ascribe some of the worst of their afflictions to a wrong cause.

[marginal insertion: in jurisprudence as in religion, swallowing absurdities is an exercise of faith, and faith is fortified by exercise.]

To accept of any theory as a reason from those who never speak to them but to deceive them and whose interest is in opposition to theirs, as that of the wolf is to that of the sheep.

To regard their afflictions as incurable, by referring them to a wrong cause.

To regard every implanted[?] and carefully cultivated abuse as an unextirpable /ineradicable/ weed, deep rooted by the hand of inexorable nature.

(It is a truth but too well known by imposters of all sorts) the more obsequious the pupil, the more powerful the instructor, and the more absurd the doctrine the stronger and more conclusive the proof given of the obsequiousness of the pupil, and of the power gained by the instructor over his mind. [marginal note: Imposters of all sorts master this; imposters of all sorts build their art upon the strength of it.] The sillier therefore the research the baser the coin which the pupil can be led to pay himself with under the name of a reason, the firmer the hold which the deceiver has on his mind.

    Section 5. 4. Weakening man's reasoning faculties

    In law, as in religion and government, the importance of this object[?] of policy is too obvious to stand in need of explanation. Strong and weak are relative terms. The strength on the one part, is as the weakness on the other. The weakness of the lay-devotee is the strength of the priest. The weakness of Louis the XIIIth was the strength of Richelieu: the weakness of Louis the XIV was the strength of Mazarin. Of the Duc de Mont[?] the Governor of one of the [...?], it was fairly said by Fontanelli, [...?] [...?] not a day but what he strove more and more to render himself unnecessary. The praise seems to have been merited: but Mont[?] was not to be depository of his [...?] power, nor ever looked to be.

    The congruity of this object in the character of a subordinate end being thus not of dispute, what remains for notice[?] are the means.

    The three preceding maxims /laws of policy/ are all subservient to this one. In addition to their respective particular uses, this use is common to them all. Keep the rule of action in the dark, discourage criticisms, promote blind admiration, be the subject what it may, what recipes can contribute more powerful towards producing the requisite object, producing a general prostration of strength in the patient the destined victim - the public mind?

    There remain two other medicaments of policy that have not yet been mentioned. 1. Inculcate in the mind of the pupil a blind reverence for antiquity in general: - for law, jurisprudential law not merely as the work of lawyers, but as the work of ancient lawyers. 2. Ply him with false wit: the particular species of false wit invented by lawyer craft for the lawyers. For though wit, true or false, is not argument, is not reason, either it may serve as a cloak to bad reason, or a substitute to good, and in either way /both may/ be conducive to the purpose.

    When we look at the persons and things [of] old times particularly the persons the scene of whose existence was placed in remote ages, at the distance at which they are placed the most with which imagination and prejudice have filled the medium through which we view them enlarges their dimensions, and presents to us ordinary men under the form of giants. Comparisons made with these of present time, if it be to body alone that the compass the measuring ruler were applied dimensions the same as those of ours would be the dimension which sober reflection would teach us to ascribe to them. But so far as in mind be the object set the dimensions exemplified in that of present time but pigmy dimensions—or rather at any rate those of half grown children would be the dimension which the same instructor would teach as to ascribe to them. “Experience is the mother of wisdom[“] so says a proverb universally named by the men of present time: yet so little do they profit by it, that the portion commonly ascribed to the inhabitants of different ages so far from being in the direct is in the inverse ratio of the quantity of experience respectively within their reach.

    What grosser or more fatal delusion than for a man to take his natural and irreconcilable enemies for his most /several/ faithful and zealous friends? upon that supposition to think and speak and not upon every /the most important/ occasion of life? with content and confidence to behold in these his enemies the arbiters of his fate? the afflictions, the grievous and ruinous afflictions, which to their profit (not to say for their profit) he is suffering dearly at their hands, to refer them to the wrath of Providence, is the perversity of [...?sable] nature[?].

    On this head a distinction seems to be commonly taken by the public mind. Lawyers are divided /are in their as in that [...?] of [...?]/ by it into classes: Attornies Advocates Judges. With the interest of the suitor the interest of the Attorney is ended but too [...?] at variance. The Attorney is accordingly a distinguishable[?] man. Between In regard /relation/ to that same public interest the /and/ interest of the Advocate there may perhaps be a little difference, but if there be, the effects of it are outweighed by the known [...?] /[...?]/ of their characters attached to their branch of the profession, and the Advocate if not the constant friend of the public, is at any rate not the constant enemy. and the Advocate, according to the scale into which the fee is dropped, is as ready /no loss/ to shew himself the friend of the public than the enemy.
