What makes the abuse the more scandalous - the grievance the more crying, is - that it is not the unextirpated remnant of antient barbarism, the continuance of which is the result of simple negligence, but a comparatively modern arrangement /grievance/, substituted within time of memory - that is of distinct history, substituted by a strong and corrupt hand, under the sleep of the legislator /during the slumber of the sovereign/ to the more simple and better practice of former times: it is the result not of primeval ignorance but of misapplied /proverbial[?]/ knowledge misapplied, like forgery and libelling it is an abuse of the grand instrument of civilization - the art of writing.

In the case of this as of every other art, the rarer the art, that is the fewer the practisers the better they were paid in proportion to the demand for their service: and the better they were paid, the more attentive /eager/ they would be to multiply as far as depended on themselves, the occasions for the practice of it, and the extent to which it was to be practiced. Hence, instead of oral /vivâ voce/ allegations supported or confuted on the spot by vivâ voce depositions, the result of reciprocal /contemparious[?] and vivâ voce interrogation, came[?] plea upon plea in writing, the writing swelled /swollen/ in each instance by as large a mass of unnecessary words /verbiage/ as the ingenuity of the learned[?] author could find a pretence for [...?] [...?]. Thus swelled /grew/ expence, with its consequent and concomitant [...?]. But writing is a work of /takes up/ time and writing in one part supposes and necessitates reading on the other: and thus delay grew out of vexation and expence: fresh delay, productive /fruitful/ in its turn of fresh vexation and fresh expence: collateral injustice in each shape being at once the effect and cause of collateral injustice in every other, frequently also the cause of direct and ultimate injustice whether in a natural way by deposition of evidence, or in the way of positive law, by a positive decision, an act of perversity and folly, refusing on this or that pretence, all alike frivolous: and without so much as the pretence of necessity, refusing to give effect to the assurances given by the substantive or rather main body [...?] of the law.

    In /To/ /Without/ the abuse of writing we have /may be seen/ the means of bringing about three /essential/ /the suitor could never have been burthened with that prodigious load of expence vexation and delay of which the exhibition of/ instruments of mutual altercation succeeding one another at intervals more or less distinct, in the particular /immediate/ efficient cause. Where an allegation /a mass of allegations/ is committed to writing, and each party is under an obligation or at liberty to answer the mass of allegations exhibited by the other, an interval of time between the exhibition of one such instrument, and the exhibition of another such instrument can not be refused. It could not, even were hired assistants out of the question: much more where the necessity of employing assistants of that description, especially if of different classes /ranks/, one believed another, has been contrived to be created. Under the system, of which vivâ voce examination as well of parties in the presence of each other as of witnesses (extraneous witnesses wherever present) forms an essential /a distinctive/ feature, all such altercations would naturally, and, saving accidental ignorance or oversights, necessarily, come out at once; come out at the first meeting.

    Before this abuse of writing, whatever allegations, relevant or irrelevant, true or false, came out in the course of the cause, must have been exhibited, by the parties, or, in the accidental case of inability to attend, by their gratuitous proxies: for the assistance /interference/ /agency/ of professional and hired agents /assistants/, not even in the character of assistants, much less in the character of proxies, could there have been any real need felt, or plausible appearance of necessity created. In the presence of the party, even where he is unfortunate enough to be obliged to purchase the treacherous service of a [...?] assistant, the art of making business can never be carried to any extent, approaching to that to which it is carried of course, when that check to professional treachery is removed.

    History

    Thus stands the matter or the facting[?] of general recurring probability grounded in the known constitution of human nature. Apply /[...?]/ to experience, descend to particulars, you will find the truth of this statement become /attested/ witness to by every page of legal history. An honest lawyer has given (without tarnish /disgrace/) what he calls the history of a suit at law: it is the history not of this /a siongle/ or that suit but of all suits - in a word of the whole system of procedure so far as the two great courts in Westminster called Common Law Courts are concerned: their birth, parentage and education - life, character, and behaviour: of the [stages?] means by which, with fals[e]hood for the master engine, injustice in all its shapes was moulded into practice. To show the progress of iniquity /injustice/ in all its stages and all its details would be laborious to require a landscape if that whole work[?] with large additions and explanations, the art of so being as critics[?] could not be found, the pleadings - the discussions between suitor and suitor were permitted to be carried on vivâ voce. Before /Till/ the service of a friend speaking for his friend had been converted into a trade, a suitor was at once compelled and permitted to speak for himself, a dishonest man was not deprived[?] from examination, nor an honest man condemned without being heard. In the art of writing great[?] [...?] [...?], the practice /exercise/ of it not being too rare to be made [...?] to be [...?] on as necessary nor too common not to [...?] are extortions /[...?]/high payments/ price[?] the [...?] was that against the suitor then advocate: the pleader to under write for his hand put a bridle upon his tongue /padlock upon his legs/, and the [...?] of an hour was open out into months and years.

    Such being the arrangement, and such the nature and order of the matter comprized in it, observe well /how/ the reasoning in which it is grounded /writ/. "Contracts reduced to writing (says he p.5.) are the most sedate and deliberate acts of the mind" and so forth: and "therefore" it is, that with him "written evidence"... has the first place (p.5.) "in the discourses of probability": meaning as it should seem in discourses [..?] on this subject the order of probability: and therefore it is that through "depositions" as he himself observes (p.53.) fall short "viz. in point of probative force) of examinations vivâ voce" yet in the /his/ scale of probative forces he assigns to them a place higher than that assigned by him to unwritten evidence alias parol evidence extracted by examination vivâ voce, as if depositions themselves were not extracted /extracted by any thing [...?]/ by examination vivâ voce: and therefore it is that putting affidavits which are not extracted by examination vivâ voce before depositions which are, for a reason which even according to his own account of it applies only to contracts, amongst so many other things which are not contracts he ranks affidavits and suppositions.

    Among the causes /sources/ of the confusion /darkness/ in which he has contrived to make[?] the whole subject one is the confounding from the very outset the question of authenticity with the question of verity: the question concerning the authenticity of a script with the question concerning the verity of the assertions contained in it. But to blow away dispel any consideration proportion of these clouds would require a volume.
