Make the most of it, the advantage you get by competition is not abolsute, it is but comparative: as between Court and Court it gives to the best qualified, or least ill qualified set of Judges, the most business: it causes each set /branch/ of Judges, or rathe /say rather/ the President if each Branch to endeavour to excell the President of the other Branch. But if both be ill qualified by Nature, competition will not remove the imperfections fixt by nature.

Again. Honour being the prize, love of Honour is the spur. But where money is out of the question, and all further ascent on[?] the [...?] of honour impossible or hopeless - especially at that time of life at which the greater number of Judges will commonly be found, is honour finds a rival, growing every day stronger and stronger, which honour himself is growing every day weaker and weaker, and that is Evil. Most other loves lose strength by /divers part with strength to[?]/ time[?]: love of case[?] receives /draws/ strength from that source.

    But where honour is out of the question, (as it will be or nearly so, in a Court composed of 4 or 5 Judges, unless all but the President, [...?], as is natural into cyphers, [...?] a Court having in [...?] 4 or 5 Judges yet in effect but one) where honour is out of the question, there remains as the only subject of competition, wrong. But if money be the subject of competition, it will be money in the shape of fees: and the incompatibility of remuneration in that shape with good judicature is a point on which I can not help flattering myself has already been put out of doubt.

    As to the benefit force and virtue of competition, once more, I am no more disposed to undervalue than to deny it. Yet, in the case in question, what there is of good /benefit/ in it, it is in individual responsibility that, if I do not instate unconscious matter it will be found to depend[?]. What is it that is to be the subject of the competition? Honour? /So it[?]/ who /So it/ shall get most honour?

    Honour hangs in the air, till it find some single head to pitch upon. Punishment? who shall stand [...?] of it? No need of competition on that ground. Reproach? Evil repute[?]? nor than neither. The /By/ probity is [...?] of A., /Court A./ the numbers of Court B. will neither be made the more punishable nor the more unpunishable, the more not the less respected. / It depends on [...?] publicity which [...?] avoids[?]/

    If then neither nor blame can be the subject of compeition at all, nor praise but with /without/ the help of individual responsibility, what is it that can! One thing, my Lord, and one thing only, viz. money. Though good and evil repute is almost a matter of monopoly in the hands of the Chief, yet money it is true may in each of the two competing Courts be divisible in any propositions, using any number of Judges that can be desired.

    Along with appropriate intellectual would thus but too probably be excluded the prime /choicest/ portion of appropriate moral aptitude. Youth it has been said and surely not altogether without reason is the season of virtue: {in particular of political virtue.} It is in that season that social affection receives /derives/ from imagination that force /stimulus/ which grows weaker and weaker in proportion as from habit /by exercise/ and unceasing attention and reflection self-regarding interest in all its branches grows /waxes/ stronger and stronger. Youth then is the season of virtue: in particular of political virtue: of social affection operating upon the most extensive scale, and with such strength as to maintain the mastery over the united force of /shut the ear[?] of the mind against the suggestion of/ self regarding interest and even social interest /affection/ operating /acting/ any less extensive scales /scale/.

    The force of this maxim seems to have been felt and well understood by the framers of that clause in French Constitutional law, by which all persons /men/ under 40 years of age are excluded from {the House of Peers.}
