Rid Yourselves

Ultram. Deput. none.

Here are a set of Fathers who can not come into existence till 12 of their offspring have come into the world to give it to them

All this while, in the province in question, the supposition that, in the province in question, a provincial deputation is in existence. But, in that same province, any such deputation - can it at the time in question be in existence? The affirmative is more than I know how to satisfy myself of.

Looking to Art. 328, I see that of the individuals who, for the formation of this body, are to be elected, the election is to be made by the District Electors (por los electores de partido)

But this District - this partido - what is it?

These Electors - who are they? how have they become such?

Go on and point out whether this partido is the same District that is to contain the 70,000 souls - and see whether these Electors do not derive their origin from the Parish meetings - and, if so, whether they can have existence until all the stages for the Election of Deputies to the Cortes have been formed, see whether Stages of Election can be formed - for the Election of Members of the Provincial Deputations before they have been formed for the Election of Deputies to the Cortes.

(see Art 325 and 326) nine Members are assigned ten

functions distinguished and numbered. Of these the first is to intervene (a) and approve the division made among the people of the taxes

To this authority is this most vital of all functions committed - not to any other:

therefore, under the Constitution, if not by this body it can not be performed at all

Now what appears to me is - that, considering what it to be done with the money if

levied, namely to be sent, (as will be seen) to Spain (per Art. 346) in any quantity

required by Spanish rulers ruling in Spain no such approbation will any such

it may be perceived with a degree of prudence and correctness, sufficient for the

purpose,- in the first stage of Election by all persons born in any part of the

'. Under the Constitutional Code as it stands, no Ultramarian Deputation can be formed; thence, nor the supposed security afforded. Ultramarian Deputation none.

    Spaniards!

I know not whether it has been noticed or no, but unless I have much deceived myself, under the Constitutional Code /Constitution/ as it stands, from no province in Ultramria can any real and legitimate deputation ever come; probably not from any; at any rate certainly not from all /every one/. But you will see. You will see whether by any possibility the conditions, the fulfilment of which is declared to be necessary, to the formation of a deputation can be fulfilled.

In regard to this matter, On this supposition two conceivable states of things will be before you.

    1. In the instance of every one of the Ultramarian provinces as enumerated in the Code, a deputation, formed according to the directions given in the Constitutional Code, is sent to, and takes its seat in the Cortes.

    2. Provinces in a certain number are prevented by self-emancipation from sending any such deputation to the Cortes sitting in Spain.

    3. Of those that continue in a state of Union, a certain number are prevented from sending to the Cortes sitting in Spain these several respective deputations.

    ' Ultramarian deputat n. none

In any Ultramarian Province, in which there exists not any Census can any Provincial Deputation have been formed, that is to say elected antecedently to the time when a deputy or set of Deputies from the Province to the Cortes have been elected.- I see not how the apparatus can have place.

Let us see the several territorial divisions one within the other like a nest of boxes of which on this occasion and for this purpose insertion is made in the Code: beginning with the smallest.

If we begin with the smallest in the first place we see the Parishes. These smallest divisions have place. I take for granted, all Ultramaria now, wheresoever there are any inhabitants. For if any part of that extent there are inhabitants not inhabiting within any Parish so far the foundation of the whole system fails of extending iteself. Inhabitants thus circumstanced are not Electors any where: they are not represented represented within the Cortes or in any of the intermediate meetings.

Of the several territorial divisions, this the smallest - the elementary division - has its name, the portion of territory thus denominated has its already known human[?] limits.

In each of these elementary divisions two meetings are ordained: 1. a meeting of all the parishoners - that is of all the citizens resident in the Parish, by these a body of men chosen in 21 or 31 in number are elected under the name of compromissarios. By these chosen Compromissarios one Elector is elected an individual are elected Provincial Electors, one two or more, as the case may be, namely those Parochial Electors, by whom at the capital town of the next most [...?] division, the Partido in which the several Parishes are included, an election of the person or persons, by whom at a meeting composed of the Electors from those several Partidos in the Province, the Election of a Provincial deputy one or more from the Province to the Cortes is to be made.
