2. Sanctionment

The other consequence is - that amidst such a diversity and such a diversity, the Judge in so far as the union of disposition and opportunity produces on his part an inclination to corruption seldom finds any difficulty in gratifying it.

With regard to aptitude of diction /phraseology/ - aptitude of phraseology on the part of the rule of action, thence security and sense of security on the part of the members of the community, thus much may with confidence be asserted with reference to the best penned /most apt/ body of European law namely that in respect of determinateness of designation as well as aptitude with relation to the only proper end of legislation the greatest happiness of the greatest number they are in a deplorable degree deficient. Using /Continuing to use /apply// the words which custom has applied to the several occasions, on each occasion the assumption they proceed upon is that of the word in question the import is adequately determinate, and scarcely perhaps in a single instance is that assumption true.

If such is the case in the instance of those bodies of law the composers /authors/ of which in /during/ the penning of it set /kept/ before them all along a determinate object of pursuit namely the greatest happiness of somebody - the greatest happiness of the Monarch whose power was employed in giving birth to them and binding force still more assuredly must it be the case in the instance of which the rule of action has from time to time been spun out in the way of inference from a work which whatsoever may have been the talent employed in the writing of it was and is of a mixt character having something of religion in it something of law with here and there a passage of history

    Appropriate intellectual aptitude again requires to be distinguished into 1. appropriate knowledge: 2. appropriate judgment.

    For maximizing appropriate official aptitude in these its several branches the arrangements and other means employed by the Constitutional branch of law may be termed Securities for these several branches of appropriate official aptitude: These securities for it, are so many efficient causes of it: they respectively so many concurrent causes: the aptitude produced by them, their joint /common/ effect.

    Preliminary Explanations

    Securities against Misrule: being Ordinances and other Arrangements proposed to be established in the State of Tripoli, with a view to their serving in that character.

    Preliminary Explanations: shewing what the nature of the case admitts of being done or attempted to be done in such a country in this view, without producing or endeavouring to produce any change in the form of Government.

    Misrule is bad Government: it comprehends whatsoever is opposite to good Government. A Government is good, in proportion as it is contributory to the greatest happiness of the greatest number: namely of the members of the community in which it has place.

    No government having any where had place that had for its main object any other than the greatest happiness of those among whom the powers of government have from time to time been shared, all governments that have ever had existence have had more or less of bad in them. Of all governments the worst have necessarily been those in which the powers of government have all of them been in the hands of one - because in that case each government has had for its object the greatest happiness of that one member: and to that object the happiness of all the other members has of course been made a continual sacrifice.

    Take any government whatsoever, for rendering it less bad than it is, whatsoever means are capable of being proposed or so much as thought of are reducible to one or other of two heads: 1. arrangements by which a change will be effected in the form of the government: 2. arrangements by which a check will be applied to the power of the ruling functionary or functionaries, without any such change.

    Arrangements which belong to the first of these heads constitute a separate subject of consideration: the set of arrangements herein proposed under the notion of serving with more or less effect in the character of Securities against misgovernment otherwise called misrule, require not any such changes: they are grounded on the supposition on which they are grounded is - that by one means or other, without any such change, the ruler or rulers may by one means /consideration/ or other be induced to lend their power to the purpose of giving to them the sanction of law.

    Preliminary Explanations:- General and preliminary Observations shewing the design and plan of the proposed system of Securities against Misrule

    Misrule is the general and all-comprehensive denomination, by which the evil, against which it is the endeavour of the here-proposed arrangements to apply a remedy, may be designated.

    Misrule can not in any other way be so clearly comprehended as by reference to Good Rule to which it is correspondent and opposite.

    Rule or say Government is good, in so far as it is contributory to the greatest happiness of the greatest number of the members of the community in question:- in as far as, taking that for its object, it is successful in the pursuit of that same object.

    Rule may therefore come under the denomination of misrule in either of two ways /accounts/: either by taking for its object the happiness of any other number than the greatest: or by being more or less unsuccessful in its endeavours to attain that object.
