3. A third reason is © that without the bridle applied by the admission of all persons without distinction to the exercise of the function performed by the penning of the original draught, the body of men possessed of the sanctionative or any consummative power with relation to it are /will/ in point of appropriate moral aptitude essentially and certainly unapt: and for any deficiency in this one of the three elements of appropriate aptitude no extra©abundance in respect of the two others would be capable of making compensation: on the contrary the evil produced by that deficiency in the one element would from any extra©abundance in the two other elements receive positive encrease.

Of this moral inaptitude the causes form [...?...?] a subject of enquiry: a very compressed indication here follows: any thing like a full development would in respect of the unavoidable bulk of it be altogether incompatible with the present design.

They will be found in the universal /universally exemplified/ and unchangeable nature of the human species /mankind/.

    But (it has been said) the greatest number, howsoever disposed, are not so fit so apt have not so much aptitude in all points taken together for making the most effectual provision for their own greatest happiness as are /is/ the ruling one with or without the cooperation of a conjunctly ruling or sub©ruling few.

    Whether they /the two parties/ be considered in the actual /established/ possession of power or in the act of obtaining possession of power /it/, the contrary will appear: it will appear, according as their respective degrees of aptitude are comprised [?] and contracted under the [...?] of /with reference/ all the several elements of appropriate aptitude.

    It will appear from the aggregate power [?] of experience from all the experience which the history of mankind down to the present moment has brought under our view

    Lastly what will moreover appear is © that whatever deficiency in respect of /in/ appropriate aptitude all its elements taken into account may have place on the part of the greatest number is not only reparable, but in a state of continual tendency towards complete /perfect/ reparation: whereas on the part of the ruling one, with or without the cooperation of a coordinately or subordinately ruling few the deficiency is altogether irreparable.

    Moreover that so far from being directed to the filling up /reparation/ of the deficiency on the part of the greatest number, the endeavours /faculties/ of the ruling one with or without the co©operation of the coordinately or subordinately ruling few have uniformly been employed in the endeavour to maintain it in the state of the greatest possible amplitude.

    III. Aptitude and Inaptitude

    Explanation

    On this occasion to prevent misconception and that the force of the reasons may be the more clearly perceptible, explanations of a few leading terms seem altogether indispensable.

    by appropriate aptitude on the part of the work in question is meant aptitude with relation to the only ultimate end which must be continually in view the greatest happiness of the greatest number, of which aptitude it is all along the business of the rationale to give indication and proof. By the explanation, the import of the property thus designated © an import which might otherwise appear indeterminate © is rendered determinate.

    On the part of the work, appropriate aptitude will depend partly upon the aptitude of each distinguishable part taken by itself, partly upon ”consistency•: upon consistency of design and execution as between part and part.

    As to both points, appropriate aptitude on the part of the work will depend upon appropriate aptitude on the part of the workman or workmen.

    On the part of the workman, the elements of appropriate aptitude may be comprehended under these three denominations: namely appropriate moral aptitude, appropriate intellectual aptitude and appropriate active talent.

    Appropriate intellectual aptitude will require to be moreover distinguished into appropriate judgment and appropriate knowledge.

    By appropriate moral aptitude is here meant neither more nor less than the disposition to contribute to the accomplishment of the all©commanding and all©comprehensive end so often mentioned. It may be termed in one word appropriate probity /”probity•/. But the attribute /adjunct/ ”moral• has the advantage of pointing and leading to the consideration of the related /kindred/ attribute ”intellectual•.

    But, it may /will/ be said, © there are the Representatives of the people © men chosen by the people for this very purpose: why not trust to them the composition of the Draught in its original state, as well as the consummation and sanctionment of it in its ultimate state

    I answer

    1. They can not have time for it: amongst them there can not be so much as one man who will have time sufficient for it. The service performed by the composition of the original draught of an all comprehensive as well as throughout rationalized body of law is an extraordinary service, if there be a service to which that epithet is applicable: It is for ordinary service © for the current service of the [...?] that they are appointed: and by no one bt whom any part is borne in the performance these ordinary services can any time be left for any, such extraordinary: more especially as it is /will be seen to be/ a necessary condition to the aptitude of the work that it be from first to last if possible the work of one and the same hand.
