Ch.12. English Review Chambers a warning to Scotland

VII. Having mentioned the assortment [of] Chambers of Review we are already provided with in Westminster Hall, as an object that might not have been unworthy of fixing, though some how or other they seem to have escaped, the attention of Your Lordships learned Reformer, when occupied in the planning of the new one proposed to be erected in Edinburgh, I proceed to present to your Lordship's consideration a slight sketch which I have ventured to take of these erections for his use: humbly conceiving, that should the edification of the Architect, by this or any other means, be substituted to the edification of the projected edifice, the change would be in no small degree an advantageous one.

    §.1. Deficiencies in the Account

    Among the incidents which have intervened since these letters were began, is one which in my humble view of the matter, may serve to throw upon the subject some useful lights. I speak of the Accounts that, in obedience to an Order of the House of Lords bearing date the 11 of March last (A o 1807) have been printed respecting the number of Appeals presented to the House in the course of two contiguous periods of seven years each, the last of them ending at that time.

    III. Contents of the Sequel of this letter

    Since the commencement of this series of Letters, and of this individual Letter in particular, divers incidents have taken place - and in particular, the introduction of the Bill - in which the Plan announced in the Resolutions has received its development - incidents from which the quantity of the matter originally destined for this Letter has received a very considerable increase. In its present magnitude, the following are the Topics, under one or other of which the whole may be found to be included -

    I. Remedies proper for prevention of malâ fide Appeals -

    §.9. Omission causes

    These heads of inquiry are they requisite and necessary for drawing the documents necessary for the comparison from the English Courts? they will be not the less requisite for the due application of the inquiry to the Irish Courts.

    Supposing, if the supposition may be endured, that the above items contain the description of the list of Appeals that in pursuance of the plan of reform as declared by the Resolution and the measures grounded on them ought to have been called for, let us now observe what are the heads that comprize the Appeals actually called for and presented in consequence. To this inquiry the clearest answer will be afforded by an Account of the heads not compized in the Account but omitted.

    1. From Westminster Hall corresponding as above to the Scottish Court of Session Appeals called Writs of Error, presented to the Lords: none.

    2. Appeals called Writs of Error presented to any of three Intermediate Courts of Appeal (the existing English Chambers of Review) consequently none.

    3. Appeals from the two other English Courts standing on the same level with and, thence making parcel of the aggregate list, corresponding to that Scotch Court: viz. Appeals to the King's Delegates, none.
