As in the production of the evils /those necessary vices/ opposite to the ends of justice no exact calculation could be made, no exact adjustment of the quantity of abuses manufactured /created/ to the quantity of profit and undue ease for the sale of which it was manufactured /created/, it would sometimes happen that a quantity of superfluous abuse would be produced, such as might be cleared away without any diminuation in the advantage flowing from the aggregate mass into the lap of the man of law.

In Scotland, so it has happened /it seems,/ this overplay[?] of abuse has swelled to a degree of enormity which perhaps has not equal any where /to which no parallel perhaps any where, certainly not even in England /would try to be found./

This surplus it is altogether in /not out of/ the order of things that a lawyer should be found to propose the cutting off, if by the cutting it off he should in any shape be a gainer: it is not out of the order of things that in the extirpation of it the whole body of lawyers should be disposed to acquiesence[?], if in the consequences of the operation it should happen to them to see what howsoever could scarcely happen to them to see no danger of loss at all in any shape, or non but what found in the per contra prospect of advantage, an adequate counter-balance.

    Splitting sections, at least with the machine invented and employed by our legislator, is not, any more than splitting of logs, an operation unattended with labour: and the proof of it is that before the business is completed /Quorum is declared/, the force of the workman /operator/ fails him, and the promised Quorum remains undeclared.

    Where lay the difficulty? Is it that the settlement of a Quorum was /is/ in its own nature too arduous an exploit /operation/ even for that noble and learned hand by which all other noble hands are led? If so, what other noble, what less-learned hand will attempt it. But no: - when a Quorum was to be settled for the whole Senate so easy was it /the operation/ found, that each time it was settled in a porch[?] it was a sort of thing that a man might settle as he ran /a mere parenthesis was sufficient for it/. When the business /task/ of settling a Quorum for a whole Senate runs off so /thus/ lightly, shall the exertions /efforts/ of our Hercules /Solon/ /Lycurgus/ be baffled by a mere half-senate? by the half of it the same Senate, which, till this inauspicious moment, had been so trustable?

    Fortunately for Scotland, the quorum-creative force /strength/ of our /her/ Solon revives, like a Giant refreshed at the like section, and then and there where a Quorum for the adjustment of naterum possession is to be established, the Presiding Judge /the Presiding Judge wheresoever it may happen to him to sit, whether at the head of the division or elsewhere, may even though he be standing the whole time/, with any those of the other Judges of the Division, total number four, is pitched upon as constituting the sufficient number without difficulty.

    But how much more fortunately, had the revival taken place a few sections earlier, and when the adjustment of Quorums was the order of the day!

    This fallacy is naturally and generally if not necessarily connected with another, viz. one of the modifications of the Vituperative-personality-utterer's fallacy /device/ viz. the Bad-principle inferrer's whose device /aphorism/ is noscitur ex consintatuis[?].

    To say nakedly and bluntly - Excellence, perfection is the object of my abhorrence - it is for itself, for its own same that I abher it, would /might/ be too much for the effrontery even of this class of politicians[?]: too much to practice in the way of effrontery on the one hand /part/, too much to expect in the way of irrational acquiesence on the other.

    Ask one of these abhorrer's of every thing that is most good why it is that he abhorrs it - his answer is ready /at hand/ - This is one of your French principles this is a principle that was maintained by Your Preistly, Your Condorcet, Your Godwin &c &c.

    Costs

    What then is to be done? The true, the effectual /efficient/, and only effectual /efficient/ remedy, is altogether simple. Take away /Remove/ the cause, the effect follows it. Take away the profit from groundless /malâ fide/ Appeal, also profit, malâ fide Appeal vanishes. Take away - but in each case you must take it away compleately, or in that case you do nothing, and the abuse continues /principles[?] //operates and succeeds/, is [...?] except [...?] the abuse.

    The remedy will take a different aspect, according as it is against delay in the principle of commercial calculation , or delay in contemplation of insolvency that it is [...?] to operate.

    Delay in contemplation of insolvency is the expected[?] mask to aim at, because that goes to the distribution[?] of the whole, the whole of the subject matter in dispute is put in jeopardy or [...?] by it /mask for the remedy to aim at to take the principal aim, because the mischief goes to //embraces// therefore[?] the whole: I mean the whole of the property //value// in dispute/.

    A man /defendant/ who has nothing /no property/ in hand but the subject matter in dispute, nor perhaps the whole off that, being burthened with debt to the whole or any part of the amount a defendant again for whom in these circumstances Judgment is pronounced, appeals of course remove the cause of course into another court, if any other be found to receive it - buys so much delay of course: so much delay on the Court above has to sell, so much time for the defendant to live at free quarters upon the Plaintiff. What then is to be done? Let possession, follow instanter[?] though but provisionally upon the judgment of the Court below, the profit of malâ fide appeal, and consequently the inducement is at an end. In that case without /unles upon/ a prospect of ultimate success to appeal is not in mans nature /no appeal can take place/: which is as much as to say, unless it be under the expectation of misdecision in the part of the Court above, malâ fide appeal or removal[?] is impossible.
