1. The greatest happiness of the greatest number requires that with reference to

the possessor or possessors of the supreme operative power the constitutive

power be in the hands of the greatest number, viz of apt hands: apt in respect

of literary acquirements.

2 The greatest happiness of the greatest number requires that the supreme

operative power legislative and Super Executive should be in the hands of a body

corporate body, the Members thereof located by Election performed by so many

assemblages of such of the Members of the whole community as are endowed with

adequate appropriate aptitude, relation had to such their functions: the

assemblages being determined by the local Districts which they inhabit and each

Member being elected by the apt inhabitants of one such District: no inhabitant

voting /deliver his vote/ in Districts more than one: each such Member being

intituled /stiled/ a Deputy or say a Delegate of the People: and the whole

legislative power being in the hands of a Congress composed of the Deputies or

Delegates of the People located as above, the supreme super-executive power be

Delegates of the people be exercised by the whole number sitting and acting in

an undivided body: no other divisions having place but such as are effected by

that same body itself: by its forming out of itself for example under the name

of Committees Sections out of itself, each Section subordinate and responsible

to the whole.

    6 The greatest happiness of the greatest number requires that the hand or hands

    in which the supreme Executive power is placed be subordinate to the supreme

    legislative body in all modes of subordination: namely 1. by power of cessation:

    2. by power of command on pain of punishment. 3. by power of punishment. 4. by

    power of dislocation but not 5. by non-concurrence.

    Q. The supreme legislative power and the /a/ supreme super Executive power why in

    the same hand?

    A. Suppose for simplicity of conception suppose the Supreme Executive power to be

    in the hand of a single functionary. If he were not displaceable by the supreme

    legislative functionary or body of functionaries their power might by him be

    reduced to impotence If he were not punishable by that same legislative body, he

    might before the dislocation could be effected produce mischief indefinitely

    intense, extensive and irremediable. He might for example put to death the

    members of it in any number. If, so far as depended upon their power and the

    orders given in consequence he were dislocated - he might refuse to submitt to

    those same orders.

    Supreme Executive Functionary be in the hand of a single individual. Stile him

    Q. The Supreme Operative power why in a single body, and not in two bodies or more

    Answer. Determining Principle

    1. Avoidance of needless Delay, say in one word dispatch

    2 Avoidance of needless Expence - Say in a word Frugality.

    Exposition of the Rationale of these principles

    Shewn already as follows

    1. The hands in which the supreme operative power is lodged ought to be located and dislocated by the great body of the people

    2. The hands in which this power is lodged ought to be not those of a single individual but those of a numerous body

    3. Of this body the Members ought to be located and dislocated by the Electors of so many Territorial Districts into which for this purpose the whole territory of the State ought to be divided.

    That point /position/ being considered as established comes now the question whether the institution of one such numerous body being determined upon, one or other or any more than one other ought to be added.

    The answer is - Not so much as one other: in which answer is included a negative upon every greater number

    If in addition to this first body there be a second, this second will either be a body having an interest not opposite in any way to the interest of the great body of the people, or a body having an interest opposite in this or that way to the interest of the people. Under the greatest happiness principle to say that among the functionaries sharing in the supreme operative power a body having an interest opposite [...? ...? ...?] of the people ought not to have place is as much as to say that it is against the interest of the people to be under the government of men having an interest opposed to theirs and in a condition to give effect to that particular interest at the expence and by the sacrifice of that universal interest.

    There remains therefore as the sole subject of the question, a second body having an interest the same as that of the people - the identity or coincidence between the two interests being provided for in the case of this second body upon the same principles as in the case of the first.

    5 The greatest happiness of the greatest number requires that no functionary be located by lot /chance/: much less by birth: in no case otherwise than by nomination or election.

    Q. Why not by chance?

    A. Reason Suppose a certain individual endowed with the maximum of appropriate aptitude, chance renders the location of that individual improbable, in the ratio of the number of individuals to whom chance allows a /admitts a/ possibility of being admitted /admission/, to one

    Q. Why not by birth?

    A. Take for example the case where the whole of the operative power in the highest grade legislative and super-executive is in a single hand. Taking birth for the efficient cause of location i.e. proximity in the line of generation /proximity/ to the last individual located, the improbability of the maximum of the aggregate of appropriate aptitude will be at the highest pitch, more particularly in respect of moral aptitude: the probability will be on the side of the maximum of inaptitude /that branch/ which corresponds to and is opposite to appropriate moral aptitude.
