Mode of riddance

In the dissolution of this union thus there would be no difficulty. But in the continuance of it on the other hand I see considerable difficulty: and I can not see how /consistently with the essentials of the Constitution/ the difficulty can be solved.

In every future Cortes in the very next that takes place which will be in less than two years, the numbers of members of the whole deputation, the numbers belonging to each of these two discordant parts and consequently the proportion between the two - members to depend upon the state /quantity/ of the population in the two countries: being to be in a certain proportion to that population: namely one for every 70,000 souls "of a certain description." In the European dominions the population is regarded as determined: the supposition being to be that it is the same as according to a census taken A o 1797 it was at that time: and thus far no difference that can have had place being likely to be attended with any practical inconvenience, /or considerable objection/ no difficulty presents itself. But in every one of the several American provinces, the Census remains to be taken: and in no one of them until the /a/ census have been taken any deputation can there be. The furnishing the Cortes with a deputy from that Cortes will therefore depend upon the local authorities on whom it will depend whether and where this same census shall be taken: an operation which especially in countries so circustanced is not quite so easily /and promptly/ performed as spoken of. In some the Constitution (Art. 30) supposes there exists perhaps at present a Census: but in so far as this happens to be true, /have place/ if he in whose custody or within his reach the census is - chooses that there should be no census, he has but to destroy the paper, and for a long time at least his will is done.

    For determining this population in Spain there exists a census though of no later

    date than 1797: and by /for this purpose to/ Art. 30. this reference is made to that

    census is made. But in no one of the ultramarian provinces, for aught appears does

    there exist any such thing as a census of any date. In every province if in any in

    which there happens to be one the article indeed[?], by necessary inference where[?]

    it to be made use of: for in express terms it declares /ordains/ that reference shall

    be made to the latest and most authentic census's, or returns in existence. The

    provision which it accordingly makes is that a census, viz. "one corresponding to the

    abovementioned last Spanish Census in 1797" shall be made for the ultramarian

    population. Well then till some time after this new Census has been made and

    completed, that part of the deputation which is to come from the ultramarian

    provinces can not come can not have been so much as chosen, nor the number of

    deputies of which it is to be composed have so much as been determined.

    In each province supposing no such Census made by whom is it to be made? Answer - By

    Art. 335 paragraph 7 th By the provincial deputation of the

    Province: that and no other is the authority provided

    But this same provincial deputation by which existence is to be given to the Census

    how is it itself to come into existence? Answer. By /By Article/ the same means, by

    which and through the same preparatory stages through which the Cortes is to come

    into existence. In each province till there has been a Census made there is to be no

    provincial deputation appointed: /chosen/ and till there has been a provincial

    deputation appointed, /chosen/ unless there happens to be a census already, there can

    be no Census.

    Male & female together, after deducting the number produced by all the disqualifications created by all those qualifications which we have seen with their exceptions, where shall we find the several groups of 70,000, by each of which a deputy to the Cortes may be sent? To this question an answer is furnished by Art. 30. For the population of the European dominions says that article, shall serve for the computation of the population, the latest census (viz) "that of the year 1797 until a new one shall have been capable of being taken."

    Thus far there is no difficulty, comparatively speaking not much difficulty: for of that date & for the European dominions a census is in existence.

    But now comes Ultramaria and there shall be formed continues the article a correspondent census for the computation of the population of the Ultramarian dominions, employing in the mean time, or as to these parts, the most authentic censuses among those which have been latest formed.

    Now then of all those /the/ several Ultramarian Provinces in number, how many are there in each of which a census is at present in existence? I should not be much surprised if not a single one can be found. If anysuch there be the list of them must have been known in the office of the Minister of the Colonies & was known & might & ought to have been known - if not, to those who framed the Constitution of 1812 to those who adopted & renewed it of 1820.

    What I should not be surprised to find is - that of those Ultramarian Provinces there is not so much as one in which any such census is at present in existence: what I sh d be much surprised if I did not find is - that in some one or more of them no such census is in existence. Let there be any one such, in this case for no part of such province can any such deputation be sent.

    A province then there is in which no such indispensable census is in existence. Yet without, no deputation from that Province can be made /come into existence/. The census for the as yet uncensured Province - how then is it to come /can it come/ into existence?

    Oh says an Advocate of the Code, there exists /will be in existence/ the Art. 325 there will be in existence If in this Province a /governing body called/ a Provincial deputation and of the /function or/ duties [...?] to that province, the seventh is to take the census and statistic account of that same province.

    To this observation /defence/ there are two answers present themselves.

    1. One is the observation which came to made on a former occasion, namely when the business of approving and dividing /and in pursuance /[...?]/ of the first of its ten duties/ among the component and subordinate districts the quota of contribution assessed upon it by the Cortes: namely that suppose should it happen that in the province in question it is more agreable to the inhabitants in general to have the saving or the spending of their own money to their own purpose than to bind it to Spain to be there spent by others for the purposes they have in order to give themselves the satisfaction all they have to do is to do nothing.

    In like manner in the present case should there be any province in which in the time in question it is more agreable to the inhabitants to have nothing to do with your rulers than to be subject to their dominion, and in that moment to forbear sending than to send a deputation to the Cortes at Madrid all they have to do is - to forbear /save/ giving themselves the trouble of taking or causing to be taken any such Census in which case the pretence for their being governed by your Cortes and your other rulers, namely those sending a deputy by whom they are represented in the Cortes, will not have place.
