Rid Yourselves
Lett. 5 Under Code, profit none
'. Deputation [...?] tax
So far from a net profit upon the balance, and by virtue of under the Constitution
as it stands, how so much as a single maravedi should ever make any such voyage in
the first instance; is more than I can see.
By Art. 335, to the body established by the Constitution, in every Province,
Ultramarian as well as Spanish under the style of the Provincial Deputation, composed
(see Art 325 and 326) nine Members are assigned ten
functions distinguished and numbered. Of these the first is to intervene (a) and approve the division made among the people of the taxes
that have fallen to the share of (b) the province.
To this authority is this most vital of all functions committed - not to any other:
therefore, under the Constitution, if not by this body it can not be performed at all
Now what appears to me is - that, considering what it to be done with the money if
levied, namely to be sent, (as will be seen) to Spain (per Art. 346) in any quantity
required by Spanish rulers ruling in Spain no such approbation will any such
Ultramarian deputation ever give.
The Members of which this body is composed who are they? Of the nine, (not to
mention the two that will be noticed[?] precisely) [...?] (per Art. 328) are to be
eleven by the District Electors, on the day following that of appointing Deputies to
the Cortes. And these District Electors by whom are they chosen? On the present canon
it may be perceived with a degree of prudence and correctness, sufficient for the
purpose,- in the first stage of Election by all persons born in any part of the
Spanish dominions, and not excluded by any one of a number of special causes, among
which no such thing as the absence of a determinate pecuniary qualification is to be
found. (c)

Title: [[clxvii. 139] 1821 March 7]Description: [clxvii. 139] 1821 March 7 Rid Yourselves Ult. [...?] '.6. Constitution paralysesthe Discourse. In Spain any such patron is to send so much money to Ultramaria. If not, [...?] justice to Ultramaria. Now, my friends, observe what chance there is that under the Constitutional Code when matters are settled a maravedi should ever reach Spain from any part of Ultramaria. How should it? Under Article 335 it can not be levied in any Province without the consent of the Provincial Deputation of the Province, the Members elected seven of them out of nine. Art. 326 328 by the inhabitants of the Province. I say not without the consent of that somebody. For of the functions nine in number attached to that body by this Article, the first is - to interview and approve /interview and approve/ the division made by the Cortes of the taxes required for the province. Now for every such approbation what can be inducement? For when the taxes are levied see what it is that is to be done with them? In the first place, whatsoever portion the constituted authorities in Spain are pleased to receive there is to be sent thither. So says Article 346 The provincial treasures shall correspond with the National Treasury, and held at its disposal the whole of their receipts, and it is by these same peninsular Constituted authorities that the question of its money to be levied for the purpose, is to be determined. So says Article 131, clauses 13 and 15. To the Ultramarian provinces respectively belongs nothing but the negation: the negation which you have just been shown. In the exercise of it is it likely they should be very reserved? That of the many so levied in Ultramaria supposing any money based there the peninsular should draw to Spain the whole, I have not any apprehension: never will the Ultramarians have any. One reason is - be the country what it may - that unless regular government be maintained in a Country /it/ no regular supply of money can be had from it. Another reason is that of the population of Ultramaria a portion and that an considerable one is always to be composed of peninsulars sent thither as above to fatten: and that for that portion at any rate of the population neither the matter of subistence nor that of abundance which be altogether wanting, will be the case of their relations and other connecting issues among the [...?] for the Provinciales.

Title: [1821. April 2 d. Rid Yourselves]Description: 1821. April 2 d. Rid Yourselves Ultram. Deput. none. Here are a set of Fathers who can not come into existence till 12 of their offspring have come into the world to give it to them All this while, in the province in question, the supposition that, in the province in question, a provincial deputation is in existence. But, in that same province, any such deputation - can it at the time in question be in existence? The affirmative is more than I know how to satisfy myself of. Looking to Art. 328, I see that of the individuals who, for the formation of this body, are to be elected, the election is to be made by the District Electors (por los electores de partido) But this District - this partido - what is it? These Electors - who are they? how have they become such? Go on and point out whether this partido is the same District that is to contain the 70,000 souls - and see whether these Electors do not derive their origin from the Parish meetings - and, if so, whether they can have existence until all the stages for the Election of Deputies to the Cortes have been formed, see whether Stages of Election can be formed - for the Election of Members of the Provincial Deputations before they have been formed for the Election of Deputies to the Cortes.

Rid Yourselves of Ultramaria Lett 4 Under Code profit none By /In/ Art. 335, I see established as far as such a law can establish it, in every Province, Ultramarian as well as Spanish, under a body of men styled Provincial Deputation in every Province, Ultramarian as well as Peninsular. Number of Members, by Articles 325, 326, named, to the whole body fuctions, ten: distinguished and numbered. In no Ultramarian provice Till the division is made - made by this body are the taxes are to be paid: paid? no: nor so much as called for. Well then - in any such province, by any such body, will any subdivision /distribution/ be made? I answer no: no: if in the breasts of the majority of the Members there be any regard for the interest of their constituents. For, supposing the money paid, note in the first place what is to be done with it, Article 346 shall give the answer: it is to be sent to Peninsula Spain there to be at the disposal of the Constituted authorities: whatsoever portion of it they please: or if they please the whole of it: a cuya disposition tendran todos sus fondos.
