1. If there were no other means of saving avoiding the use of exempting delinquents from the

punishment of death than the giving encouragement to perjury

on the part of Jurymen the encouragement mischief thus done thus given

whether useful upon the whole or not, would not be absolutely

devoid of use. But [+] a much more surely efficacious simple

[+] in on the particular occasions instances in question as in on all others

as well as more simple efficacious made of avoiding the

use of this pernicious mode of punishment is in man's

power, viz. the abolishing it ceasing to employ it.

2. If there were no other on the part of the legislator means of avoiding the use of the

punishment of death than the giving encouragement con y at the disobedience to

the Judge and immediately practiced by in the subornation of perjury in the part of

Jurymen, the mischief thus done, whither productive of

real advantage or no upon the whole, would not be absolutely

devoid of use. But on the particular occasions

in question as in on all other others occasions a much more

surely efficacious as well as more simple mode of avoiding the

use of this pernicious mode of punishment is in mans

power, viz. the ceasing to employ it.

3. Go in so with the other mischiefs? or abridge?
